Abortion in San Marino

Abortion in San Marino was legalized on 26 September 2021 by referendum. Previously, it was generally illegal.

Previous Penal Code[]

Articles 153 and 154 of the imposed prison sentences for any woman who procured an abortion, any person who helped her and any person who performed the abortion. Abortions performed to save the life of the mother were generally permitted by legal principles of necessity, but the law made no specific exceptions.[1][2][3]

History[]

A proposal to liberalize abortion law was submitted during 1974 revisions to the Penal Code, but the Government deferred it indefinitely to permit further debate. The referendum for abortion legalization was held on 26 September 2021, and legalized abortion with a 77.30% vote in favor,[4] allowing for the voluntary termination of pregnancy up to the twelfth week of gestation and also thereafter if there is danger to the life of the woman, if the fetus has malformations or if the pregnancy presents a serious risk to the physical or psychological health of the woman.[5]

Before its legalization, abortion could likely be obtained in neighboring Italy,[1] according to a United Nations Population Division report.
