The Somaliland nationality law (Somali: Xeerka Jinsiyadaha Somaliland; Arabic: قانون الجنسية في صوماليلاند), is dictated by the Somaliland Constitution, adopted on 13 June 2001.[1][2] Citizenship Law No: 22/2002 Article 4 of the constitution of the Republic of Somaliland. This Law was passed by the House of Representatives on 1 March 2002 and was signed by the President on 3 June 2002.

The First Independent Somaliland Citizenship Law[]

With Somaliland's independence from Britain approaching, the Somaliland Legislative Council passed on 23 June 1960 the Somaliland Citizenship and Citizenship Act 1960 [3] (Decree No. 15 of 1960) which came into effect with the first constitution of Somaliland three days after independence. Somaliland on June 26, 1960.[4]

The Second Somaliland Nationality Law[]

On 18 May 1991, the representatives of the people of Somaliland decided to restore their sovereignty as an independent state and reaffirmed their nationality and nationality in Somaliland. The Initial National Pact (1993) that was followed by the Interim Constitution (1997) for Somaliland was replaced by the constitution that was approved in a national referendum on May 31, 2001.

Citizen[]

Article 4 of the Constitution of the Republic of Somaliland states:

  • Any person who is a patrial of Somaliland who is a descendant of a person residing in Somaliland on 26 June 1960 or earlier shall be recognised as a citizen of Somaliland.[5]

Citizenship by birth[]

1 A Somaliland citizen by birth is any person whose father is descended from persons who resided in Somaliland on June 26, 1960, and earlier.

2 A Somaliland citizen by birth may acquire the citizenship of another country (dual nationality) without losing Somaliland citizenship.

3.Unless he voluntarily waives his right to Somaliland citizenship, any adult offspring of a Somaliland citizen residing in a foreign country or a citizen of another country or a refugee in another country may acquire Somaliland citizenship on the first return to Somaliland.
